01Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Sunshine Network platform, websites, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business, and “you” refers to that business.

If you do not agree to these Terms, do not use the Service.

02The Service

Sunshine Network is an all-in-one digital marketing platform for small businesses. It includes an AI-generated, hosted website, a CRM, email and SMS marketing, privacy-first analytics, reputation tools, and — depending on your plan — additional features you can enable from your dashboard.

We may add, change, or remove features over time. We aim to give reasonable notice of material changes that reduce core functionality.

03Your Account and Conduct

You are responsible for the accuracy of the information you provide, for maintaining the security of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use.

You agree not to use the Service to:

• Break the law or infringe anyone’s intellectual property or privacy rights.
• Upload malware, or attempt to breach, disrupt, or probe our systems.
• Send unlawful, deceptive, or unsolicited bulk messages.
• Misrepresent your business type or territory to gain an exclusivity you are not entitled to.
• Resell or provide the Service to third parties except as expressly permitted.

You are solely responsible for the content you publish and the messages you send through the Service, including compliance with anti-spam laws such as CAN-SPAM and TCPA.

04Territorial Exclusivity

Territorial exclusivity means that, while your subscription is active, no other Sunshine Network client of the same business type and service focus will be active in your claimed territory. Exclusivity is scoped to the specific combination of business subtype, service focus, and territory you claim, and it is enforced automatically by our system.

Exclusivity applies only to businesses on the Sunshine Network platform; it does not restrict competitors who are not our clients. If you cancel or your subscription lapses, your territory is released and becomes available to others.

05Subscriptions, Billing, and Taxes

Plans start at $99/month (Standard), with Growth ($179/month) and Premium ($299/month) tiers. Fees are billed in advance through our payment processor, Stripe, on a recurring monthly basis using the payment method on file. Subscriptions renew automatically until cancelled.

New accounts include an initial minimum commitment of six (6) months. Fees are non-refundable except where required by law. You are responsible for any applicable taxes. If a payment fails, we may retry and may suspend the Service until the balance is resolved. We will give notice before any price change takes effect.

Where you use the Service to collect payments from your own customers, those payments are processed through your connected Stripe account and are subject to Stripe’s terms and any disclosed platform fee.

06Cancellation and Suspension

After the initial six-month commitment, you may cancel at any time with 30 days’ notice; your subscription remains active through the end of the current billing period. On cancellation, your hosted website is taken offline and your territory is released.

We may suspend or terminate your account for non-payment or for a material breach of these Terms. Where practical, we will give you an opportunity to cure a breach first. You may export your data before cancellation; after termination we handle remaining data as described in our Privacy Policy.

07Intellectual Property

Your content stays yours. You retain ownership of the business content, logos, images, and data you provide. You grant us a limited license to host, process, and display that content solely to operate the Service for you — including generating your website with AI based on the details you supply.

Our platform stays ours. The Sunshine Network platform, software, templates, and brand are owned by us and protected by law. These Terms grant you a right to use the Service, not ownership of it.

08Disclaimers, Liability, and Governing Law

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties and do not guarantee that the Service will be uninterrupted, error-free, or that it will produce any particular business result.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months before the claim, and neither party is liable for indirect, incidental, or consequential damages.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws rules. We may update these Terms from time to time; material changes will be reflected in the effective date above and, where appropriate, notified to you. Questions? Contact us.
